Reviewing the Contract:
Protecting You Before You Sign

You don’t buy property every day.
You don’t read sales contracts every day.
We do — and we read them very thoroughly.

Thorough, Experienced Eyes

That experience means we can easily spot when something is unusual, incomplete or requires further investigation.

One common example is an overly generic contract. This can indicate that the vendor’s solicitor or conveyancer didn’t receive sufficiently detailed instructions. When that happens, it’s a sign to us that our due diligence needs to be even more thorough than usual.

We’ve seen cases where:

A standard contract form is used and key sections on the front page haven’t been completed.

Standard conditions or special conditions you would expect to see simply aren’t included.

There’s rarely malicious intent — but when details aren’t clearly spelled out, the purchaser and vendor may have very different expectations.

It’s always better to clarify early.

When the Contract Raises Questions

There are also situations where something in the contract requires further information. Alterations and renovations are a common example. We ask additional questions about:

  • Council approval
  • Builder’s warranties
  • Certificates of compliance
  • Supporting documentation
Our Process

Our process is simple and strategic.

We review the contract thoroughly, raise enquiries, collect the relevant information — and only then come back to you with clear advice.

There’s no point raising concerns until we have clarity.

Due Diligence

Council Searches &
Property Inspections

When you’re buying property in NSW, due diligence doesn’t stop at the contract.

We’re ready to assist with any searches and inspections you may need.

We work extensively across the Hills District and have strong relationships with local councils. Even if you’re purchasing outside the area — for example, selling in the Hills and moving elsewhere — we understand how councils operate and know exactly what questions to ask.

Property transactions often move quickly. Having someone who understands local council processes and requirements can make a significant difference.

Helping You Understand
All Your Options

Identifying an issue is only the first step.
If something arises during your contract review or searches, we don’t just point it out — we outline your options.

Only you can decide what’s right for you.

Our role is to ensure you understand every possible path, along with the risks attached to each one.

The “right” option depends entirely on your goals and circumstances.

We take the time to get to know you and your priorities. Often we have a good idea of what you’ll want to do — but we’re careful to make you aware of all available options, plus any risks associated with each.

That way, you’re fully informed and able to make the best decision for you.

For example

If renovations on the property you’re buying are not council-approved, your options may include:

  • Insisting the vendor complete additional work to obtain approval.
  • Negotiating a lower purchase price (particularly during the cooling-off period).
  • Adjusting your negotiation strategy if you’re lining up two settlements on the same day to avoid paying rent or living in limbo.
  • Deciding that the issue doesn’t matter to you at all — perhaps you plan to knock down and rebuild, or convert an extra bedroom back into the garage it originally was.

When Should You Have
the Contract Reviewed?

The ideal time to review your Contract for Sale in NSW is:

After your offer is accepted —

But before you sign or exchange contracts.

A quick review and phone discussion means you can raise necessary changes or ask further questions while you’re still negotiating.

If the market is hot, you may have less leverage than during a slower market — but in either case, the time before you sign anything is when you have the most negotiating power.

That window matters.

Understanding the Cooling-Off Period in NSW

A standard private treaty contract in NSW includes a cooling-off period of five business days.

Why it matters

Even if we’ve only conducted a quick initial review, this period is extremely valuable. It gives us time to:

  • Follow up on unclear details
  • Confirm inclusions
  • Clarify special conditions
  • Conduct further searches if required

How we use it

It’s a second opportunity to ensure you’re protected.

However, cooling-off periods are short — and they pass quickly.

Acting early gives you far more control.

Buying at Auction:
Why Pre-Auction Review Is Critical

If you purchase property at auction in NSW, there is no cooling-off period.

Once the hammer falls, you are legally bound to proceed under the terms of the contract.

That’s why it’s vital to have the contract reviewed before auction day.

If you’re buying a property listed for auction and agree on a price prior to auction, you’ll likely be asked to sign a Section 66W Certificate. This document waives your cooling-off period.

Again, once you sign, you’re committed.

In both situations, pre-contract review isn’t just recommended — it’s essential.

On Your Side from Start to Finish

Buying property is exciting — but it can also be stressful.
There are large sums of money involved. Tight deadlines. Legal terminology that isn’t part of everyday life.

Our role as conveyancers is to be on your side and defend your interests throughout the entire process.

We don’t go to court. We focus on conveyancing. That means we’re not pulled away to appear before a judge when you need us.

Our attention is on your transaction.

We specialise in buying and selling property. We understand:

The importance of cooling-off deadlines
The negotiation power you have before exchange
The risks of incomplete contracts
The need for clarity and fast, practical advice
